Welcome to Élan Aviation (“Élan,” “we,” “our,” or “us”). By accessing our website or using our services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. About Our Services
Élan is an air charter broker under 14 CFR Part 295. We do not own or operate any aircraft. We arrange air transportation on behalf of our clients with independent third-party air carriers who are properly certified under Part 135 of the Federal Aviation Regulations or the foreign equivalent.
2. Use of Our Services
You must be at least 18 years old to use our services. You agree to provide accurate, complete, and current information when requesting a quote or booking a flight. You are responsible for all activity that occurs under your account or as a result of your use of our services.
3. Quotes and Bookings
All quotes are subject to availability and may change until a flight is confirmed. A binding agreement is formed only when we provide written confirmation of your booking. All flights are operated by third-party air carriers, and the terms and conditions of the operator may apply.
4. Payments
Payment terms will be provided at the time of booking. By providing payment information, you authorize us to process payments on your behalf to the applicable air carrier. All payments are non-refundable unless otherwise stated in writing.
5. Cancellations and Changes
Cancellations and modifications are subject to the policies of the air carrier operating the flight. Fees may apply. We will communicate any applicable charges prior to confirming changes on your behalf.
6. Limitation of Liability
Élan acts as an intermediary and is not liable for any acts or omissions of third-party air carriers or for any delays, cancellations, or other events outside of our reasonable control.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
8. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a new effective date.
